I'd think that knowingly selling HIV-tainted blood products should be a criminal matter, Professor. Life prison sentences would do much more to curb such practices than large awards to dying victims, though I grant that the lawyers might not make as much dough off the tragedy.
Even in the case of criminal activity, the presence or absence of strong civil penalties should still impact incentives–given the differing burdens of proof.
